WHAT RETURNING PROBATIONERS ARE NOW OWED
Now that thousands of probationary employees are coming back to their desks, it is time to pay attention to the remedies they are entitled to. It is a longer list than you might imagine. Here is our list of things local union reps need to pay attention to. We suggest reps seek out retrurning probationers to inform them of all they are owsed, suggest they contact the union if something go wrong, remind them that it was unions that got them their jobs back and of course leave them a SF-1187.
- Back pay owed
- Interest on the back pay owed
- Retroactive health benefit coverage
- Retroactive life insurance coverage in case someone passed while terminated
- Restoration of annual and sick leave that would have been earned. If the agency already paid out the earned annual leave, the right to repurchase the leave credits.
- FERS contributions
- Matching TPS contributions
- Retroactive payment of any differentials, allowances, and stipends, e.g., public transit, childcare, recruiting, etc.
- Retroactive payment of all taxes
- Retroactive payment of any overtime the employee would have earned “but for” the very illegal termination
- Restoration of any compensatory time earned before termination
- Retroactive promotion or within-grade increases that employees would have received “but for” the illegal termination
- Retroactive conversion to career status for those employees who would have completed their probationary period “but for” the illegal termination
- Retroactive time in grade credit.
